
Comedy icon Ai-Ai delas Alas’ petition to make her estranged husband Gerald Sibayan a permanent resident in the U.S. as her spouse has officially been revoked.
The development comes from the U.S. Citizenship and Immigration Services (USCIS) that favored Ai-Ai’s plea to withdraw her “Petition for Alien Relative” for Gerald which she filed on July 2021.
The petition was successfully revoked due to the comedienne citing her former beau having a “third party” while in a nearly decade-long relationship with her.
At the time, however, Ai-Ai addressed rumors about revoking Gerald’s green card, clarifying that she only viewed it as helping with his legal status rather than taking it away.
It can be recalled that months after confirming her split with Sibayan during an exclusive interview on her 60th birthday, Delas Alas shared cryptic posts about a cheater and their mistress on her Facebook account.
The agency’s decision read as quoted by PEP.ph: “After a thorough review of your petition and the record of evidence, we must inform you that the approval of your petition has been automatically revoked.”
According to USCIS, Sibayan will not be able appeal to the said decision unless Delas Alas will file a motion to reopen or reconsider the case.
Aside from revoking his green card, Gerald’s travel and work permits in the U.S. have also been revoked as requested by Ai-Ai in her Withdrawal of Approved I-130 and Adjustment of Status letter to USCIS.
“Please revoke any issued work and travel permits attached to this case. I also withdraw any affidavit of support issued as part of this case,” the actress’ letter read.
In PEP.ph’s interview with Ai-Ai’s US-based legal counsel, Atty. Pia Dyquiangco, they are currently determining Gerald’s response to the petition to revoke his permanent residency in the country.
“He will not be benefitting from Ai-AI’s petition. It is Ai-Ai’s prerogative as the petitioner whether to push through with the petition or no,” Atty. Dyquiangco said.
“Because of the pending divorce, she is being truthful to USCIS about the state of her marriage. What he does after this is up to him and with regard to his immigration he is on his own,” she added.
